1. Scope and contracting party

These Terms of Service apply to all orders placed through the online shop at www.createdbyill.com.

These Terms apply exclusively. Any differing terms proposed by the customer do not become part of the contract unless we expressly agree to them in writing.

A consumer within the meaning of these Terms is any natural person entering into a transaction for purposes that are predominantly outside their trade, business or profession.

2. Contract language and formation of contract

The contract may be concluded in German or English.

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the button that completes the order process, you make a binding offer to purchase the items in your cart.

We will confirm receipt of your order by email without delay. This acknowledgement does not yet constitute acceptance of your offer. The contract of sale is concluded once we expressly declare acceptance or dispatch the goods.

We store the contract text and send you your order details together with these Terms by email. Before submitting your order, you can review and correct your entries at any time using the correction functions of your browser and shopping cart.

3. Prices and shipping costs

All prices shown are final prices and include statutory VAT. Shipping costs as shown at checkout are added.

For deliveries to countries outside the European Union, customs duties and import charges may apply. Whether these are already included at checkout or collected on delivery is set out in our Shipping Policy.

We reserve the right to change our prices at any time. The price displayed at the time of your order applies to that order.

4. Payment

The available payment methods are shown during the order process. The purchase price is due for payment upon conclusion of the contract.

Where payment is made through an external payment service provider, that provider's terms apply in addition. If you are in default of payment, we are entitled to charge statutory default interest.

5. Delivery

Processing times, delivery times, carriers and the treatment of customs and import charges are governed by our Shipping Policy, which forms part of these Terms.

If an ordered item is unavailable, we will inform you without delay. If you have already paid, we will refund the amount immediately.

For deliveries to consumers, we bear the risk of loss of and damage to the goods until they are handed over to you or to a person nominated by you. For deliveries to business customers, the risk passes on handover to the carrier.

6. Retention of title

The delivered goods remain our property until payment has been made in full.

7. Withdrawal and returns

Consumers have a statutory right of withdrawal. In addition, we offer a voluntary return policy. Both are described in detail in our Returns & Refunds policy, including the model withdrawal form.

8. Statutory warranty

Statutory warranty provisions apply. For consumers, the warranty period for movable goods is two years from delivery.

If a defect appears within one year of delivery, it is presumed to have existed at the time of delivery. In the event of a defect you are entitled to repair or replacement and, subject to the statutory conditions, to a price reduction or rescission of the contract.

Please report any defect to office@createdbyill.com. We bear the costs of a justified warranty claim, including shipping.

9. Product characteristics and materials

Our pieces are largely produced in small series and partly by hand. Minor variations in dimensions, surface finish and colour compared with the product images are inherent to the materials and do not constitute a defect.

Colours may appear differently on screen depending on your device and its settings.

Gold-plated surfaces are subject to natural wear when worn regularly. Care instructions are provided with the individual products. Wear from normal use is not a warranty issue; premature loss of plating under intended use is.

10. Vouchers and discount codes

Unless stated otherwise, discount codes cannot be combined with other promotions, cannot be exchanged for cash and are valid only within the stated period.

If an order in which a discount code was redeemed is returned in whole or in part, we refund the amount actually paid.

11. Liability

We are liable without limitation for damage arising from injury to life, body or health, and for damage caused intentionally or through gross negligence.

For slight negligence we are liable only for breach of a material contractual obligation, and limited in amount to the foreseeable damage typical of this type of contract.

Claims under the Austrian Product Liability Act remain unaffected. Any further liability is excluded.

12. Dispute resolution

If you have a complaint, please contact us directly first at office@createdbyill.com. We aim to resolve every issue amicably.

The competent alternative dispute resolution body for online trade in Austria is the Internet Ombudsstelle, Margaretenstraße 70/2/10, 1050 Vienna (www.ombudsstelle.at). We are not obliged to participate in dispute resolution proceedings.

13. Governing law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected by this choice of law.

Proceedings against consumers may only be brought before the court at their domicile, habitual residence or place of employment. If the customer is a business, the place of jurisdiction is Linz, Austria.

14. Final provisions

Should any provision of these Terms be or become invalid, the validity of the remaining provisions is unaffected. The invalid provision is replaced by the applicable statutory rule.

We reserve the right to amend these Terms. The version published at the time of your order applies to that order.
